1. Scope of these Terms
These Website Terms of Use ("Terms") govern access to and use of neuraldefend.com and the public pages, materials, and features that link to these Terms (collectively, the "Website").
The Website is operated by Neural Defend Private Limited ("Neural Defend," "we," "our," or "us"), a company incorporated in India under corporate identity number U63999DL2024PTC429114. If you do not accept these Terms, do not use the Website.
These Terms govern the public Website only. A passive Website visit does not bind your employer or another organization to customer-service obligations.
2. Separate terms for Neural Defend Services
These Terms do not grant access to, or govern the provision of, Neural Defend's contracted detection products, software, application programming interfaces, customer portals, support services, or related offerings (collectively, the "Neural Defend Services").
Access to Neural Defend Services is restricted to authorized users provisioned by Neural Defend or a customer administrator and is governed by executed customer documents. Those documents determine their own scope and order of precedence. A Website description does not amend a customer agreement or create a commitment to deliver a product, feature, certification, service level, or deployment option.
3. Eligibility and permitted use
The Website is intended for business users aged 18 or older. Subject to these Terms, Neural Defend grants you a limited, revocable, non-exclusive, non-transferable right to access and use the Website for lawful informational and internal business purposes.
No right is granted to use Neural Defend software, models, application programming interfaces, datasets, customer documentation, or other materials made available only under a customer agreement.
4. Acceptable use
You must not, directly or through another person:
- Use the Website in violation of applicable law or third-party rights.
- Interfere with the integrity, availability, performance, or security of the Website.
- Attempt to gain unauthorized access to an account, system, network, or non-public area.
- Introduce malware, harmful code, or content designed to disrupt or compromise a system.
- Bypass access restrictions, rate limits, robots instructions, or other technical controls.
- Conduct vulnerability or penetration testing without Neural Defend’s prior written authorization.
- Scrape, harvest, reproduce, or extract Website content through automated means except for ordinary compliant search-engine indexing, accessibility technology, or another use authorized by law.
- Use Website content to train, evaluate, or improve a machine-learning system without prior written permission.
- Impersonate Neural Defend or misrepresent an affiliation, endorsement, or source.
5. Intellectual property and feedback
The Website, including its design, text, graphics, logos, product names, documentation, audiovisual materials, software, and other content, is owned by Neural Defend or its licensors and is protected by applicable law. Except for the limited permission in Section 3, no license or right is granted by implication, estoppel, or otherwise.
If you voluntarily provide a suggestion or feedback about the Website, you grant Neural Defend a worldwide, perpetual, irrevocable, royalty-free right to use and incorporate it without restriction or payment. Do not provide confidential information as feedback unless a written agreement protects it.
6. Third-party websites and services
The Website may link to a third-party website or service, including an external scheduling provider. A link is provided for convenience and does not imply that Neural Defend controls, endorses, or accepts responsibility for the third party's content, availability, security, or practices.
Your use of a third-party service is governed by that provider's terms and privacy notice.
7. Privacy and product-data statements
Our Website Privacy Policy explains how we handle personal information associated with the Website. Our Cookie Policy explains our use of cookies, browser storage, analytics, and similar technologies.
Our Zero Data Retention Policy describes how Neural Defend handles customer content submitted for analysis. We do not save customer images, video, audio, or other submitted content.
These policies and statements are statutory or informational notices. They are not incorporated into these Terms as commercial warranties. Executed customer documents govern Neural Defend Services.
8. Informational and product content
Website content is provided for general business information. It is not legal, regulatory, financial, audit, certification, cybersecurity, identity, fraud-investigation, or other professional advice.
Research, benchmark, detection, accuracy, and performance information may depend on the dataset, configuration, attack type, threshold, hardware, deployment conditions, and evaluation method. Results in one setting do not guarantee results in another.
We may change Website content, product descriptions, technical information, and availability. Only a signed customer agreement or order form executed by authorized representatives can create a binding commitment concerning Neural Defend Services.
9. Reporting security concerns
Send a concise security report to support@neuraldefend.com and allow reasonable time for investigation. Do not publicly disclose or exploit a suspected vulnerability, and do not include customer media, credentials, personal information, or confidential data unless Neural Defend provides an approved secure method and requests the information.
Submitting a report does not authorize testing that violates these Terms or applicable law.
10. Disclaimers and liability
10.1 Disclaimer of warranties
To the maximum extent permitted by applicable law, the Website and its content are provided on an "as is" and "as available" basis. Neural Defend disclaims all warranties, representations, and conditions, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded or disclaims an express factual statement that applicable law requires Neural Defend to make accurately.
10.2 Limitation of liability
To the maximum extent permitted by applicable law, Neural Defend and its directors, officers, employees, affiliates, licensors, and service providers will not be liable for an indirect, incidental, special, exemplary, consequential, or punitive loss, or for loss of profits, revenue, opportunity, goodwill, use, or data, arising from or relating to the Website or these Terms.
These limitations do not apply to liability that cannot lawfully be excluded or limited.
11. Changes, suspension, and termination
We may modify the Website or these Terms. The Last Updated date identifies the current version. If a change materially affects Website users, we will provide additional notice where reasonably appropriate or required by law.
We may restrict or terminate Website access where we reasonably believe that use violates these Terms, creates a security or legal risk, infringes another person's rights, or could cause harm. You may stop using the Website at any time.
12. Governing law and general provisions
These Terms and any non-contractual dispute arising from them are governed by the laws of India, without regard to conflict-of-law rules. Subject to any mandatory right that applicable law grants you, the courts located in Delhi, India have exclusive jurisdiction.
12.1 Severability and no waiver
If a provision is held unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. A failure or delay in exercising a right does not waive that right.
12.2 Assignment and entire agreement
You may not assign these Terms without Neural Defend's prior written consent. Neural Defend may assign them in connection with a reorganization, financing, merger, acquisition, or transfer of the Website or relevant business.
These Terms constitute the entire agreement concerning use of the public Website. They do not replace a signed customer agreement.
